USER AGREEMENT

1. GENERAL PROVISIONS

   1. This agreement regulates the legal relationship between the User of BitMedia website (hereinafter referred to as the User) and the Administration of this website (hereinafter referred to as the Administration), arising in the process of using the services of this website. The agreement prescribes the basic rights and obligations of the parties, and responsibilities that arise in the case of a default on obligations.
   2. The User is a person who has reached full age, registered on this site (opened an account), read and agreed with the privacy policy.
   3. The owner of the account is the one who has the information about the password and email address of the account. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to:
      • immediately notify BitMedia of any unauthorized use of your password or account or any other breach of security, and
      • ensure that you exit from your account at the end of each session. BitMedia cannot and will not be liable for any loss or damage arising from your failure to comply with this paragraph.
   4. By using this website, the User is entitled to place ads (advertisement) on Publishers’ websites for a fee, in order to promote his product (service), thus, receiving the status of an advertiser.

2. PROVISIONS RELATED TO ADVERTISING

   1. All advertisements placed by the User are checked for compliance with moral and ethical norms of society. All advertisements can be placed in graphical and text formats. The placed advertisement shall be manually moderated and should comply with the requirements of BitMedia, regardless of its type.
   2. It is prohibited to place advertisements that contain:
      • direct download links;
      • viruses and malicious software;
      • links to sites with automated scripts;
      • links pages with redirects;
      • links to fishing sites;
      • links to websites promoting violence, the use of drugs and other substances illegal in most of the countries.
      1. Copyrighted content – content that violates the intellectual property rights of another person, the legal owner of the content.
      2. Information (visual, textual), which the Administration considers to be explicitly sexual or shocking (including but not limited to images or texts, describing reproductive organs of humans or animals, sexual intercourse or violence).
      3. The Administration reserves the right to refuse the User to place his advertisement if the advertisement does not meet the requirements of the internal policy of the website or any other reasons the Administration considers essential.
      4. By prior agreement with the Administration of the site, advertisement of the following is allowed:
         • Adult sites – advertising of such a product can be placed only on the advertising platforms that allow placement of this type content. The prerequisite placement of this material is the legality of its origin.
         • Gambling sites – advertising of such product can be placed only on the advertising platforms that allow placement of the content of this type.
         • Healthcare-related content - online and offline pharmacies – advertising of such product can be placed only on advertising platforms that allow the placement of materials of this type.
         • Political parties, governmental and non-governmental organizations. Advertising of such product can be placed only on advertising platforms that allow the placement of this type of materials and should correspond to the requirement of authenticity.
      5. The list of advertising materials outlined in paragraph 2.4. of this Agreement is not exhaustive.The administration can, in its sole discretion and unilaterally, expand the list of materials, advertising of which requires prior approval of the Administration.
      6. Only direct links to a landing page are allowed to be used as the URL. The server has to give the “response code of 200” and the page has to be uploaded without redirects.
      7. The Administration of this site does not guarantee that User’s advertising will bring him money and any other income (dividends).
      8. Requirements for the quality of promotional materials are as follows:
         • A displayed URL should demonstrate the content of URL landing page. It is forbidden to mislead Users manipulating the name and content of the displayed URL (for example, to set display URL – google.com, and then send Users to facebook.com).
         • It is forbidden to place ads using common phrases that do not allow Users to determine the approximate content of the ad before they click on it (for example: “Buy our products” is forbidden, while “Buy our green T-Shirts” is allowed).
         • It is forbidden to use letters, numbers, symbols and words in order to enhance the visual image of ads, but not their content (for example, FREEE!!!”, “FR-E-E-E!, DOLLAR$$).
         • Links to websites that are in the process of developing, parked domain sites or broken sites are not allowed.
      9. Websites that are not displayed (cannot be viewed) in the most commonly used modern browsers are not accepted.
      10. One of the offered opportunities of BitMedia website is Targeting Advertising Materials. In this regard, Advertisers can benefit from addressing exclusively the desired audience.
          • Advertisers can take advantage of BitMedia targeting to determine the audience that will be shown promotional materials. Targeting sets can be installed inside an advertising campaign.
          • Targeting options and features are subject to change. In this regard, the addition of new advanced options and features is possible just as elimination of those that appeared to be less functional.
   3. BitMedia does not require the confirmation of the product ownership to advertise it.
   4. If the ad is placed illegally and there is either a proof thereof or the complain of the owner of the product, the administration reserves the right to resort to the following measures:
      • deactivate the ad bloсks
      • freeze the funds, held on the account balances
      • block the account

3. TRAFFIC REQUIREMENTS

   1. The Administration checks the traffic, which the User uses several times, including the application of internal and external anti-fraud systems for its compliance with the standards of the website.
   2. In case when the traffic is inconvertible, the funds paid by the User will not be returned, since the Administration does not guarantee that the User shall gain a profit. The primary purpose of the website is to enable the User to advertise.
   3. If the system of automatic or manual traffic analysis reveals the evidence of fraud that led to the loss of User’s funds, the funds can be docked from the Publisher’s account and returned to the User’s account.
   4. BitMedia guarantees correspondence of the display of advertisements to the chosen options of targeting, defined by the user for his advertising campaign.

4. PAYMENT

   1. All transactions conducted via this website are calculated in Bitcoins.
   2. Before the beginning of advertising, the User has to top up his main account for a certain amount of Bitcoins. For verification, Bitcoin-transaction has to pass at least three network confirmations. Afterwards, the funds will be available for financing advertising campaigns.
   3. The User undertakes to follow all necessary steps to ensure that only he has the access to his account, in order to prevent identity and money theft.
   4. After the User has paid for advertising, the money is not refundable.
   5. The User may add or withdraw money from his main account at any time.

5. REFERRAL PROGRAM

   1. This paragraph is aimed to define the process of providing the User with the rights of enjoyment and gaining profit from participation in the referral program.
   2. For the purposes of this section the following are explained:
      • Referrer – is the User participating in the referral program and receiving compensation for engagement of every new User;
      • Referral – a new User, engaged by a Referrer.
   3. Every user is entitled to participate in the referral program.
   4. Each user is provided with a special link indicating its unique ID. All new (unregistered in the system before following the link) Users who used the offered link and went to the website will be automatically marked with a (referral) cookie-record, which will remain active for 30 days.
   5. New registered user of the website is checked for the referral cookie-record. If the new User was invited by the referral (one of the valid users of BitMedia), he automatically becomes an indefinite referrer of this User.
   6. The user will always be provided with an access to his referral statistics, which includes: the number of clicks on one’s referral link, the number of registrations and revenue. The user has the access to the statistics on the page of the referral program inside his account.
   7. The user (referral) receives income in accordance with the number of new invited users (referrers) and the current condition of the referral program.
   8. The Administration reserves the right to change conditions of the terms of use, access, gaining profit from referral program unilaterally without informing the user. The user can read the current conditions of the referral program on the webpage: bitmedia.io/referral. BitMedia always adds and counts dividends from referral program in accordance with the conditions regarding these matters.
   9. Transit to the website of BitMedia from the advertising block of the Publisher is not considered to be a referral i.e. those for who the Referral can receive a reward. Referral transitions are considered to be only transitions from the special links provided to the User.

6. FINAL PROVISIONS

   1. The Administration is not responsible for any damage or losses caused to the User related to hacking of his account and a theft of funds from his account.
   2. The Administration is not responsible to users, publisher or any third party for claims regarding the violation of intellectual property rights and the compensation of damages.
   3. The Administration is deemed to have fulfilled its obligations after the User has had the opportunity to advertise on the website.
   4. In case of technical or any other problems related to the use of this website, the User should contact the Administration immediately and explain the problem clearly. The Administration is committed to reply and make every effort in order to solve the problem, within 5 days of the receipt of User’s notice.
   5. All disputes arising between parties shall be settled through negotiations.
